1. Agreement to Terms

By accessing or using the NurseClex website (nurseclex.com) and related services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

NurseClex reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

NurseClex provides online NCLEX preparation services, including but not limited to:

  • Practice questions and examinations
  • Video tutorials and educational content
  • Study guides and materials
  • Progress tracking and analytics
  • Personalized learning plans
  • Mobile and web-based access to educational resources

3. Account Registration and Security

3.1 Account Creation

  • You must be at least 18 years old to create an account
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account

3.2 Account Responsibilities

  • One account per user - sharing accounts is prohibited
  • You are responsible for all activities under your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payment Terms

  • Refunds must be requested within 30 days of initial purchase

  • Reverse engineer or attempt to extract source code
  • Transmit malicious code or engage in harmful activities

6. Intellectual Property Rights

6.1 NurseClex Content

  • All content, including questions, videos, text, graphics, and software, is owned by NurseClex or its licensors
  • Content is protected by copyright, trademark, and other intellectual property laws
  • You receive a limited, non-exclusive, non-transferable license to access and use the content for personal study purposes only

6.2 User-Generated Content

  • You retain ownership of any content you submit to NurseClex
  • By submitting content, you grant NurseClex a worldwide, royalty-free license to use, display, and distribute such content
  • You represent that you have the right to submit any content and that it does not violate third-party rights

7. Privacy and Data Protection

  • Your privacy is important to us
  • Our Privacy Policy governs the collection, use, and disclosure of your personal information
  • By using our services, you consent to the collection and use of information in accordance with our Privacy Policy

8. Educational Disclaimers

8.1 No Guarantee of Exam Success

  • NurseClex provides study materials and preparation tools
  • We do not guarantee that you will pass the NCLEX or any nursing examination
  • Success depends on individual effort, preparation, and other factors beyond our control

8.2 Supplementary Educational Tool

  • Our services are intended to supplement, not replace, formal nursing education
  • Content is for educational purposes and should not be considered medical advice
  • Always consult official NCLEX resources and nursing educators for authoritative guidance

8.3 Content Accuracy

  • While we strive for accuracy, we cannot guarantee that all content is error-free or current
  • Nursing standards and practices may change over time
  • Users should verify information with official sources

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • NurseClex shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim
  • We are not responsible for any damages resulting from use or inability to use our services
  • We do not warrant uninterrupted or error-free service

10. Indemnification

You agree to indemnify, defend, and hold harmless NurseClex, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the service

11. Termination

11.1 Termination by You

  • You may cancel your subscription at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to the service until the end of the paid period

11.2 Termination by NurseClex

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Fail to pay required fees
  • Use the service in a manner harmful to NurseClex or other users

11.3 Effect of Termination

  • Upon termination, your right to use the service ceases immediately
  • We may delete your account and associated data
  • Termination does not relieve you of payment obligations incurred before termination

12. Technical Requirements and Service Availability

12.1 System Requirements

  • Compatible internet browser with JavaScript enabled
  • Stable internet connection
  • Mobile devices must meet minimum system requirements as specified

12.2 Service Availability

  • We aim for 99% uptime but cannot guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for service interruptions beyond our reasonable control

13. Third-Party Services and Links

  • Our service may contain links to third-party websites or integrate with third-party services
  • We are not responsible for the content, privacy practices, or terms of third-party services
  • Your interactions with third parties are solely between you and the third party

14. Dispute Resolution

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
